Terms of Service

These Terms of Service ("Terms") govern your use of the KonnectWear mobile application for Android, the KonnectWear Wear OS watch application, and the KonnectWear website (collectively, the "Service"), operated by UnboxedJS ("we," "our," or "us").

By downloading, installing, or using KonnectWear, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to create an account. Users under 18 must have parental or guardian consent. Parents or guardians may create and manage accounts for children under 13 within their family wellness circle.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and complete information when creating your account.
• Notify us immediately of any unauthorized access to your account.
• Not share your account credentials with others.
• Not create multiple accounts for the same person.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Fall Detection & SOS Alerts

KonnectWear provides fall detection and SOS alert features on compatible Wear OS devices. You acknowledge and agree that:

• Fall detection uses consumer-grade accelerometer sensors and a threshold-based algorithm. It is not a certified fall detection system.
• False positives (detecting a fall when none occurred) and false negatives (failing to detect an actual fall) will occur.
• SOS alerts are sent to members of your wellness circles. This is not a substitute for calling emergency services (e.g., 911, 112, 999).
• You must always call emergency services directly in a medical emergency. Do not rely on KonnectWear for emergency response.
• Fall detection requires the watch to be worn on the wrist and may not function correctly during high-impact activities, water exposure, or device malfunction.

5. Subscription Plans & Billing

5.1 Plans

KonnectWear offers the following plans:

• Solo (Free) — 1 circle, 1 member, 5 challenge groups, basic health data, watch sync.
• FamCare ($4.99/month) — 2 circles, 5 members each, 20 challenge groups, full health monitoring, wellness alerts & SOS, minimal ads.
• Elite ($9.99/month) — 10 circles, unlimited members, 100 challenge groups, full health & alerts, no ads, priority support.

5.2 Billing

Paid subscriptions are billed through Google Play. By subscribing, you agree to Google Play's terms of service. Subscriptions auto-renew monthly unless cancelled. You can manage or cancel your subscription from Google Play settings.

5.3 Refunds

Refund requests are handled by Google Play per their refund policy. We do not process refunds directly.

5.4 Plan Changes

We reserve the right to modify subscription pricing or features with reasonable notice. Existing subscribers will be notified before any changes take effect.

6. Wellness Circles

Wellness circles allow you to share health data with family, friends, or caregivers. By joining or creating a circle:

• You consent to sharing your vitality status, daily steps, health snapshots, and emergency alerts with other circle members.
• You agree to use shared health information responsibly and not for harassment, discrimination, or any unlawful purpose.
• Circle owners and admins can manage membership but cannot access more data than other members.
• You may leave a circle at any time, which immediately stops data sharing with that circle.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to the Service or other users' accounts.
• Interfere with or disrupt the Service's infrastructure.
• Abuse the SOS or alert system by sending false emergency alerts.
• Use health data shared within circles to harass, stalk, or discriminate against others.
• Reverse-engineer, decompile, or disassemble the application.
• Create accounts using automated methods.

8. Intellectual Property

KonnectWear, including its design, code, content, logos, and branding, is the property of UnboxedJS and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

Your health data remains yours. We do not claim ownership of your personal or health data.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Health data will be accurate, complete, or timely.
• Fall detection or SOS alerts will function correctly in all circumstances.
• The Service will meet your specific requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNBOXEDJS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR DEATH, ARISING FROM YOUR USE OF THE SERVICE.

This includes, without limitation, any damages arising from:

• Inaccurate health data from consumer-grade sensors.
• Failure of fall detection or SOS alert features.
• Delayed or undelivered wellness notifications.
• Actions taken based on health information displayed in the app.
• Unauthorized access to your account or data.

11. Termination

You may delete your account at any time from within the app or via our Account Deletion page. Upon deletion:

• Your profile and personal data will be permanently deleted.
• Your health data will be deleted within the retention period.
• You will be removed from all circles.
• Active subscriptions should be cancelled separately through Google Play.

We may terminate or suspend your access for violation of these Terms, with or without notice.

12. Governing Law

These Terms are governed by applicable laws. Any disputes shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
